What are the types of title deed in Turkey? A question that arouses the curiosity of many who are interested in buying a property in Turkey, especially since the types of title deed in Turkey are different from what is customary in the Arab countries. There are many stages that the title deed goes through until reaching the final state.

Greater Turkey Real Estate Company today shares with you a fundamental topic that must be well understood before buying an apartment in Turkey. We will discuss all types of title deed in Turkey, and the most important details that must be known when examining any title deed in Turkey, let’s discover them together.

What are the types of title deed in Turkey?

Let us first know what the Tapu is, which means “title deed”, which is a document that is organized for a specific property that includes information indicating the place, location, and quality of this property. This document is provided by the Turkish Ministry of Environment and Urbanization.

The title deed in Turkey consists of two types, the first of which is the red title deed “residential or commercial title deed” and the second is the blue title deed “the title deed of all kinds of lands.” Each of them has several forms, and we will start talking with you about the red title deed.

The first type is the red title deed

It is organized for real estate owners in the following forms:

  • Real estate located in complexes and apartment buildings.
  • Independent properties such as detached villas or villas in complexes.
  • Commercial real estate from shops or home office and hotel apartments.
  • Other real estate from factories of all kinds.

Other than that, it belongs to the blue title deed “land Tapu.” This Tapu includes four main types:

First, the title deed of participatory ownership (Devre mülk)

it means that the ownership of the property is shared by several people, specifically certain times of the year, and even specific days as well, and it is at least seven days, and this type is used in real estate for holidays and the like as well.

Secondly, the easement title deed (Kat irtifakı)

The floor easement title deed is presented to real estate owners when the property is under construction. This title deed is obtained at the start of construction of projects, residential buildings, and others. It is full ownership, but it has not reached the final state, which is the title deed of full ownership.

However, this type turns into the final state when all the standards imposed by the municipality are applied, in addition to obtaining the housing document “the property or the complex is eligible for housing” and all the property information is also written in it.

Third, the title deed of full ownership (Kat Mülkiyeti)

The title deed of full ownership is the final state of the development stages of the red title deed, as this title deed determines the numbering of the property in an independent and integrated manner, and this type is submitted after obtaining the housing approval that is obtained by the municipality.

For what we mentioned previously of real estate, whether residential or commercial or any other type, it is preferable that the title deed should be of this specific type, because it allocates the ownership of the property in the correct and safe form and preserves the value of the property in the long term.

The second type is the blue title deed “land title deed of all kinds”

This document is regulated to all types of landowners in Turkey, and the owner may be one person or several people, for example a specific land for an entire family, and each family has a certain share, and here all the names of the property owners are registered in the title deed, which are of two types:

First, the title deed of agricultural land Tarla/Arazi

This title deed is organized for agricultural lands so that these lands are designated for agriculture only, and here we cannot construct any residential building or even a small hut due to the lack of a construction permit.

There are some cities that allow construction in these lands at a rate of 5%, and others may never allow until after the urban expansion next to these lands, this type is the gateway to the second type, ” reconstruction land plot”.

First, the land plot of the reconstruction Arsa

This title deed is organized to build on the relevant land and of all kinds, for example, the construction of residential buildings, villas, factories, warehouses, private use and …, and the percentage of construction varies from one city to another, this type of the cab be turned into the red title deed.

Crucial things to pay attention to when inspecting the title deed of any property

  • First, the type of title deed and its consistency with the property, for example, “a residential title deed equals a residential apartment.”
  • Secondly, the location of the property in terms of section and island and comparing it with the location of the property.
  • Third, the name of the property owner in the title deed with the person concerned when inspecting the property or purchasing.
  • Fourth, the share allocated to the property and its consistency with the area of the property.
  • Finally, the history of the property, but it does not appear in the title deed, but rather through the real estate appraisal.

In conclusion,
